Having heard the appellant and the respondent relative to Erf: 8988  – 22 Plein St Paarl Western Cape Province, the Tribunal having considered all relevant factors finds:-

  1. The Appeal is upheld
  2. The reasons therefore:
  • The submission of the respondent made to Heritage Western Cape was inadequate due to
    • The Respondent failed to complete the said Annexure to the Application to Heritage Western Cape as required given the fact that it was a Grade 2 area, that additional information would be required, and it failed to do so.
    • The application referred to in 2.1.1 did not contain sufficient information to enable Heritage Western Cape in investigate the site as a heritage resource.

The application did not fully:

  • Identify the significance of the building and the site; and or
  • The impact of the grading
  • Although the Drakenstein Heritage foundation had made submissions regarding the heritage significance of the building, Heritage Western Cape had failed to investigate the matter further, and relied in the insufficient information provided by the respondent.
