: NOTIFICATION OF AVAILABILITY OF REVISED FINAL ENVIRONMENTAL IMPACT ASSESSMENT REPORTS FOR THE PROPOSED UMSINDE EMOYENI WIND ENERGY FACILITY

In a letter dated 05 September 2017, the Department of Environmental Affairs (DEA) rejected the
submission of the Final EIA Reports that were submitted in April 2016, in accordance with Regulation
34 (1) (a) of the EIA Regulations, 2010. The letter states: “In terms of Regulation 56 (2) of the EIA
Regulations, 2010 before the EAP managing an application for environmental authorisation submits a
final report compiled in terms of these Regulations to the competent authority, the EAP must give
registered interested and affected parties access to and an opportunity to comment on the report in
writing. However after review of the abovementioned documents it was found that the EAP did not
comply with the above provision and had submitted the report to the Department and I&APs at the
same time”.
In light of the above the Department required that “Revised” final reports be made available to all key
stakeholders, Organs of State, and registered I&APs for a duration of 30 days for comment. A
notification letter dated 08 February 2018 was send in this regard.
It has been identified that the previous notification letter (dated 08 February 2018) advising of the
availability of the revised Final Environmental Impact Assessment Reports (FEIAr) for comment,
contained a potentially confusing error. In order to remove any potential misunderstanding, an
additional 30 day commenting period has been made available for all registered I&APs. As such, please
be informed that the revised Final Environmental Impact Assessment Reports (FEIAr) for each of the
two Wind Energy Facilities and two Grid Connection phases will be available from the 3 April 2018
to the 4 May 2018, for further perusal and comment.

Please be informed that as a result of, inter alia, certain queries and comments that were raised during
the public review process for the Draft EIA Reports, the Issues and Responses Report (IRR) has been
updated to incorporate all the comments received.
Four individual EIA reports have been updated for each project component (Volume I). The Public
Participation Process (Volume II) and Specialist Reports (Volume III) apply to each of the four reports.
Should you have any comments on the Revised Final EIA Reports, please submit comments directly to
the DEA (information provided below), and copy in the EAP. All comments received will be collated and
submitted to the DEA at the end of the 30 day comment period as part of a revised EIA report.
Following submission of the Revised Final EIA Reports, the DEA will either accept or reject the reports.
Once the Final EIA Reports have been accepted by the DEA, the DEA will make a decision on the four
applications.
All comments on the Revised Final EIA Reports should be submitted to Mr Herman Alberts,
HAlberts@environment.gov.za at the Department of Environmental Affairs, Private Bag X 447, Pretoria
0001, citing the relevant DEA reference numbers stated above, with a copy to Nobuhle Hughes,

In ‘n brief gedateer 05 September 2017 het die Departement van Omgewingsake (DEA) die voorlegging
van die Finale OIS-verslae wat in April 2016 ingedien is, verwerp, ooreenkomstig Regulasie 34 (1) (a)
van die OIS-regulasies, 2010. Die afkeuringsbrief lui: “Ingevolge Regulasie 56(2) van die OIAregulasies,
2010, moet die OAP wat die aansoek om omgewingsklaring hanteer, voordat dit ’n finale
verslag, saamgestel ingevolge die bepalings van hierdie Regulasie, aan die relevante owerheid voorlê,
die geregistreerde belanghebbende en geaffekteerde partye toegang tot die verslag gee en ’n
geleentheid om skriftelik daarop kommentaar te lewer. Nadat die bogenoemde dokumente nagegaan
is, is egter bevind dat die OAP nie bogenoemde voorwaarde nagekom het nie en die verslag
tegelykertyd aan die Departement en die B&GPe voorgelê het.”
Die Departement vereis dat die finale verslae beskikbaar gestel word vir alle belangrike
belanghebbendes, Staatsorgane en geregistreerde B & GPe vir ‘n tydperk van 30 dae vir kommentaar.
Daar is geïdentifiseer dat die vorige kennisgewingbrief (gedateer 08 Februarie 2018) adviserend van
die beskikbaarheid van die hersiene Finale Omgewingsimpak-assesseringsverslae (FEIAr) vir
kommentaar, vervat ‘n potensieel verwarrend tikfout. Ten einde, om enige potensiaal misverstand te
verwyder, is ‘n addisionele 30 dae kommentaarperiode beskikbaar gestel vir alle geregistreerde B &
GPe. As sodanig moet u asseblief in kennis gestel word dat die hersiene Finale Omgewingsimpakassesseringsverslae
(FEIAr) vir elk van die twee Windkragfasiliteite en twee Netwerkverbindingsfases
vanaf 3 April 2018 tot 4 Mei 2018 vir bestudering en kommentaar beskikbaar sal wees.

Let asseblief daarop dat as gevolg van onder andere sekere navrae en kommentaar wat tydens die
publieke hersieningsproses vir die Konsep OIB-verslae geopper is, die uitgawe- en antwoordverslag
(IRR) opgedateer is om al die kommentaar wat ontvang is, in te sluit.
Vier individuele OIA-verslae is opgedateer vir elke projekkomponent (Volume I). Die publieke
deelnameproses (Volume II) en Spesialisverslae (Deel III) is van toepassing op elk van die vier verslae.
Indien u enige kommentaar op die Hersiene Finale OIA-verslae wil lewer, dien dit asseblief regstreeks
by die Departement van Omgewingsake (DEA) in (inligting hieronder verskaf), met ’n afskrif aan die
OAP. Alle kommentaar wat ontvang word, sal saamgestel word en aan die einde van die 30 dae
kommentaarperiode voorgelê word as deel van ‘n hersiene OIB-verslag.
Ná die indiening van die Hersiene Finale OIA-verslae, sal die DEA die verslae óf aanvaar, óf afkeur.
Sodra die Finale OIA-verslae deur die DEA aanvaar is, sal die DEA ’n besluit oor die vier aansoeke neem.
Alle kommentaar oor die Hersiene Finale OIA-verslae moet nie later nie as 4 Mei 2018 aan mnr.
