PROPOSED REGULATIONS ON PUBLIC CONSULTATION IN THE PROCLAMATION OF HERITAGE REGISTERS AND HERITAGE AREAS

Heritage Western Cape is tasked with the management of heritage resources in the Western Cape. Sections 30 and 31 of the National Heritage Resources Act, Act 25 of 1999, (the NHRA) make provision for the proclamation of Heritage Registers and Heritage areas at a local authority level. These registers and areas may then be managed by the local authority, should it be found by HWC to be competent to do so.
Many local authorities have identified potential heritage areas and compiled inventories of heritage resources and proposed heritage areas. However before these may obtain formal protection in terms of the NHRA, there must be consultation with property owners as property rights will be affected. The NHRA provides that regulations must be drafted to provide for the procedure to be followed in such consultation. These regulations have been drafted and it is proposed to present them to local authorities and other interested and affected parties in order to explain the implications of the regulations and the resulting formal protections. As these regulations will have implications on heritage management at local authority level, it is requested that Local Authorities attend if they are able. .
